For enterprise and custom service agreements, specific Service Level Agreements (SLAs) may be provided detailing:

• Uptime guarantees and availability commitments

• Response and resolution times for support requests

• Performance metrics and benchmarks

• Service credits or remedies for SLA breaches

SLA terms, if applicable, will be specified in the individual service agreement or Statement of Work (SOW).

ARHSUB Technologies implements reasonable technical and organizational safeguards to protect systems and information. However, no online platform or transmission method can be guaranteed to be completely secure.

Users are responsible for maintaining appropriate security practices, including protecting credentials, devices, and account access.

Our services or website may integrate with or contain links to third-party platforms, applications, or services. ARHSUB Technologies is not responsible for the availability, security, accuracy, or practices of third-party services.

Use of third-party services may be subject to separate terms and privacy policies. You acknowledge and agree that ARHSUB Technologies has no control over third-party services and assumes no liability for your use of such services.

To the maximum extent permitted by applicable law, ARHSUB Technologies' total aggregate liability arising from or related to these Terms or the services shall not exceed the amount paid by you to ARHSUB Technologies in the 12 months preceding the claim.

ARHSUB Technologies shall not be liable for any indirect, incidental, consequential, special, punitive, or business-related damages including but not limited to loss of profits, revenue, business opportunities, data, goodwill, or business interruption, even if advised of the possibility of such damages.

Some jurisdictions do not allow limitation of certain damages, so these limitations may not apply to you.

The services and website are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.

ARHSUB Technologies expressly disclaims all warranties including but not limited to merchantability, fitness for a particular purpose, non-infringement, title, quiet enjoyment, accuracy, and uninterrupted availability.

We do not warrant that the services will meet your requirements, be error-free, secure, or available at all times.

For paid services, the following payment terms apply:

• All fees are quoted in the currency specified in the service agreement or invoice

• Payment is due within 30 days of invoice date unless otherwise specified

• Late payments may incur interest at the rate of 1.5% per month or the maximum allowed by law

• ARHSUB Technologies reserves the right to suspend services for non-payment after providing reasonable notice

• All fees are exclusive of applicable taxes, which are the client's responsibility

Refunds for services are evaluated on a case-by-case basis and are subject to the terms of the specific service agreement. Generally:

• Subscription services: Refunds may be provided for unused portions if cancelled within the first 30 days

• Custom development: Refunds are based on work completed and milestones achieved

• Consulting services: Non-refundable once services have been rendered

• Setup and onboarding fees: Generally non-refundable

Refund requests must be submitted in writing to billing@arhsub.com within 30 days of the charge.

You agree to indemnify, defend, and hold harmless ARHSUB Technologies, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your violation of these Terms

• Your use or misuse of the services

• Your violation of any third-party rights

• Any content or data you submit through the services

• Your violation of applicable laws or regulations

ARHSUB Technologies shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, civil unrest, government actions, internet or telecommunications failures, cyber attacks, pandemics, or other force majeure events.

In the event of force majeure, ARHSUB Technologies will make reasonable efforts to resume normal operations and may suspend services temporarily without liability.

ARHSUB Technologies reserves the right to suspend, restrict, or terminate access to the services or website at its discretion, with or without notice, if users violate these Terms or engage in activities that may harm the company, systems, or other users.

Upon termination:

• Your right to access the services immediately ceases

• You remain liable for any outstanding fees or obligations

• ARHSUB Technologies may delete your data after a reasonable retention period

• Provisions related to intellectual property, liability, and indemnification survive termination

In the event of any dispute arising from these Terms or the use of services:

• The parties shall first attempt to resolve the dispute through good-faith negotiations

• If not resolved within 30 days, either party may pursue arbitration or legal proceedings

• Disputes shall be resolved in accordance with the laws of India

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the services shall be subject to the exclusive jurisdiction of the competent courts located in India.

If modification is not possible, the provision shall be severed, and the remaining provisions shall continue in full force and effect.

These Terms, together with any service agreements, privacy policy, and other referenced documents, constitute the entire agreement between you and ARHSUB Technologies regarding the use of our services and supersede all prior or contemporaneous communications, agreements, or understandings, whether written or oral.

ARHSUB Technologies reserves the right to update or modify these Terms at any time to reflect changes in services, legal requirements, technology, or business practices.

Material changes will be communicated through email notification or prominent website notice at least 30 days before taking effect.

Your continued use of the services after the effective date of modified Terms constitutes acceptance. If you do not agree to the changes, you must discontinue use of the services.
